Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Caribbean Sports Quest website (the "Service") operated by Caribbean Sports Quest ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding your password and for any activities or actions under your password, and must notify us immediately of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity, a name or trademark subject to the rights of another without authorization, or a name that is otherwise offensive, vulgar, or obscene.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Caribbean Sports Quest and its licensors, protected by copyright, trademark, and other laws of both Jamaica and foreign countries. You retain all rights to content you submit, post, or display on the Service, and grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing and promoting the Service.

Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to violate any applicable law, exploit or harm minors, send spam or unsolicited promotional material, impersonate CSQ or any other person, or restrict anyone else's use or enjoyment of the Service. You further agree not to use robots, spiders, or automated means to access or copy the Service, use software that interferes with its proper working, introduce viruses or other malicious material, or attempt to gain unauthorized access to the Service or its servers and databases.

Event Organizers

If you create, publish, or manage events through our Service you agree to provide accurate, complete, and truthful event information (date, time, location, pricing, restrictions), honor all ticket sales and registrations, communicate changes or cancellations promptly, comply with all applicable consumer protection and data privacy laws, and not organize illegal, fraudulent, or harmful events. Refunds and cancellations for tickets and registrations sold through the Service are governed by CSQ's Return & Refund Policy, not by individual organizer policies. We may review, remove, or suspend any event listing that violates these Terms.

Payments and Refunds

Certain features of the Service require payment, including event tickets, race and camp registrations, and merchandise. Prices are displayed in Jamaican Dollars (JMD) unless otherwise stated at checkout. Refunds, cancellations, and returns for all purchases are governed by CSQ's Return & Refund Policy, incorporated into these Terms by reference. Travel and accommodation bookings made through third-party providers are subject to that provider's terms; CSQ may earn an affiliate commission and is not the merchant of record for travel transactions. By contacting CSQ via WhatsApp you agree we may use that number to respond and, where you have opted in, send event updates and ticket alerts — reply STOP to opt out. We use third-party payment processors, whose terms also apply.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, including if you breach the Terms. Upon termination your right to use the Service ceases. Provisions which by their nature should survive termination — ownership, warranty disclaimers, indemnity, and limitations of liability — survive.

Limitation of Liability

In no event shall Caribbean Sports Quest, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from your use of or inability to use the Service, third-party conduct or content on the Service, or unauthorized access to your content. CSQ does not guarantee the accuracy, completeness, or usefulness of any event information listed, and is not responsible for the conduct of any user, including organizers and attendees.

Consumer Rights

Nothing in these Terms limits your rights under the Jamaica Consumer Protection Act, the Data Protection Act 2020, or other applicable consumer protection legislation. If you believe CSQ has not resolved your complaint fairly, you may contact the relevant consumer protection authority in your territory.

Governing Law

These Terms are governed and construed in accordance with the laws of Jamaica, without regard to conflict of law provisions. Our failure to enforce any right or provision is not a waiver. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

Changes to Terms

We may modify or replace these Terms at any time at our sole discretion. If a revision is material we will try to provide at least 30 days' notice before new terms take effect. Continued use of the Service after revisions become effective constitutes acceptance of the revised terms.
